    1. About these Terms

    These Terms and Conditions ("Terms") govern the provision of building inspection services by Oxford Blue Pty Ltd (ABN 27 676 768 344), trading as VG Inspect ("VG Inspect", "we", "our", "us"), to you, the customer ("you", "your").

    By booking, confirming, or paying for an inspection with VG Inspect, you agree to these Terms. If you do not agree, do not book an inspection.

    2. Definitions

    In these Terms:

    • "Booking" means a confirmed inspection appointment where you have ticked all required acceptance checkboxes and a confirmation has been issued.
    • "Builder" means the licensed building contractor or tradesperson responsible for the construction works at the Property.
    • "Inspection" means the visual building inspection service performed by an Inspector on the Property.
    • "Inspector" means the QBCC-licensed inspector engaged by VG Inspect to perform the Inspection.
    • "Property" means the building, lot or site identified in the Booking.
    • "Quote" means a written price estimate provided by VG Inspect for an Inspection.
    • "Report" means the written inspection report issued by VG Inspect following the Inspection.
    • "Standards" means the Australian Guide to Standards & Tolerances and other applicable Australian Standards and Queensland Building and Construction Commission (QBCC) requirements current at the date of the Inspection.

    3. Inspection Scope and Methodology

    3.1 VG Inspect conducts visual building inspections in accordance with the Standards. Inspections are non-destructive and non-invasive: the Inspector will not move furniture, lift fixed coverings, or disassemble any part of the Property.

    3.2 Inspections are performed from positions reasonably accessible during a normal visual inspection. The Inspector will not access areas that present a safety risk, are obstructed, or are otherwise inaccessible at the time of inspection.

    3.3 Reports identify, where reasonably observable:

    • (a) Safety hazards;
    • (b) Suspected non-compliance with applicable Australian Standards and the National Construction Code;
    • (c) Substandard workmanship;
    • (d) Incomplete works; and
    • (e) Suspected non-compliance with the building contract and specifications.

    3.4 Inspections are visual only. The Inspector does not test electrical, plumbing, mechanical, or other systems beyond visual observation. Measurements are taken on a sample basis and are not intended to be exhaustive.

    3.5 Hidden defects, including but not limited to those concealed within walls, floors, ceilings, or subfloor areas, are outside the scope of a visual inspection. The absence of a defect from the Report is not a representation that no defect exists in concealed or inaccessible areas.

    3.6 Inspections cover the inspection type specified in the Booking. If you require additional inspection types (for example, pest, asbestos, or specialist engineering), these must be engaged separately.

    3.7 Inspector qualifications. VG Inspect uses inspectors holding current Queensland Building and Construction Commission (QBCC) licences appropriate to the inspection type. VG Inspect's principal inspector is Adam Gates, QBCC licence 1318443.


    4. Liability and Limitations

    4.1 The Report is provided in good faith based on the Inspector's professional opinion at the time of inspection. The Report is an opinion, not a guarantee or warranty of the Property's condition.

    4.2 Your contract for the construction works is with the Builder, not with VG Inspect. Your statutory warranties, including those under the Queensland Building and Construction Commission Act 1991 and the Australian Consumer Law, apply to the Builder and licensed tradespersons. VG Inspect is not party to your construction contract and is not liable for:

    • (a) Construction defects in the Property;
    • (b) Builder breaches of contract;
    • (c) Disputes arising under your statutory warranty;
    • (d) Delay, defect, or non-completion of the construction works.

    4.3 VG Inspect's liability is limited to the quality and timeliness of the Inspection and Report.

    4.4 To the maximum extent permitted by law, VG Inspect's total liability for any claim arising out of or in connection with these Terms, the Inspection, or the Report (whether in contract, tort, statute, or otherwise) is limited to the fee actually paid by you for the relevant Inspection.

    4.5 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.

    4.6 You must notify VG Inspect in writing of any claim, error, or omission in the Report within fourteen (14) days of receipt. Claims received after this period may be considered at VG Inspect's discretion but are not guaranteed to be acted on.


    5. Payment Terms and Report Release

    5.1 Quotes are valid for three (3) months from the date of issue. All prices are in Australian dollars and include GST.

    5.2 A booking is confirmed when the Client accepts the quote via the booking confirmation link. Acceptance of the quote constitutes acceptance of these Terms and Conditions.

    5.3 An invoice will be issued no later than seven (7) days before the scheduled inspection date. For bookings made within seven (7) days of the scheduled inspection date, the invoice will be issued immediately upon booking confirmation.

    5.4 Payment in full is required before the inspection commences. The inspection will not proceed without cleared payment received in VG Inspect's nominated account. No report — draft or final — will be produced or released in the absence of payment.

    5.5 If payment is not received by the day of the scheduled inspection, the inspection will not proceed. Rescheduling is at VG Inspect's discretion and subject to availability. Repeated failure to pay may result in cancellation of the booking under clause 6.

    5.6 The written report will be provided to the Client following the inspection in accordance with these Terms.

    5.7 Cancellation by the Client more than 24 hours before the scheduled inspection entitles the Client to a full refund. Cancellation less than 24 hours before the scheduled inspection forfeits 50% of the inspection fee (representing allocated inspector time). Cancellation by VG Inspect for any reason entitles the Client to a full refund.

    5.8 In the exceptional case that VG Inspect agrees in writing to provide services on credit, interest of 10% per annum applies to amounts unpaid 30 days after invoice date, calculated daily. The Client is liable for all recovery costs, including debt collection and legal fees.


    6. Cancellation, Refund and Quote Validity

    6.1 Quote validity. Quotes are valid for three (3) months from the date of issue unless otherwise stated. After the validity period, pricing is subject to change.

    6.2 Customer cancellation — 24-hour full refund. If you cancel a Booking within twenty-four (24) hours of confirming and paying, you are entitled to a full refund of fees paid.

    6.3 Customer cancellation — after 24 hours. Cancellations made after the 24-hour window but more than forty-eight (48) hours before the scheduled Inspection are refunded in full, less a $50 administration fee.

    6.4 Cancellations within 48 hours of the Inspection. Cancellations made within forty-eight (48) hours of the scheduled Inspection are non-refundable, except at VG Inspect's discretion or where required by law.

    6.5 Auto-cancellation. If you have not paid the Inspection fee within five (5) days of the Booking confirmation, the Booking is automatically cancelled and the time slot is released. To re-book, a new Quote and confirmation are required.

    6.6 Rescheduling. Rescheduling requests received more than forty-eight (48) hours before the scheduled Inspection are accommodated free of charge, subject to availability. Within 48 hours, rescheduling is at VG Inspect's discretion and may incur a fee.

    6.7 No-show or denied access. If the Inspector attends the scheduled Inspection and is unable to conduct it due to no-show, denied access, or unsafe site conditions, the full fee is payable. A re-attendance fee applies for any subsequent visit.

    6.8 Refund processing. Approved refunds are processed within five (5) business days to the original payment method.


    7. Scheduling and Partner Inspector Referral

    7.1 VG Inspect uses reasonable efforts to schedule Inspections at the time agreed with you. Scheduling is subject to inspector availability, weather, site safety, and reasonable operational factors.

    7.2 VG Inspect cannot guarantee inspector availability for every requested inspection stage, particularly where construction timing changes at short notice. Where VG Inspect cannot fulfil the Booking with its own inspectors, VG Inspect may refer the Booking to a partner inspector who meets the same QBCC licensing standards and who will honour the original Quote.

    7.3 If VG Inspect needs to reschedule the Inspection for operational reasons, you will be given as much notice as reasonably possible. You may cancel and receive a full refund, or accept the rescheduled time.

    7.4 Property access. You are responsible for ensuring the Property is accessible to the Inspector at the scheduled time. This includes coordinating with the Builder, any tenants, or third parties as required.

    7.5 Site safety. The Inspector reserves the right to suspend or terminate the Inspection if site conditions present an unacceptable safety risk. If the Inspection is terminated for safety reasons before completion, fees are pro-rated.


    8. Privacy and Data Handling

    8.1 VG Inspect collects, uses, and stores personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, even where not strictly required by the Act.

    8.2 Information we collect. We collect:

    • (a) Identification and contact information (name, email, phone, address);
    • (b) Property details for the Inspection;
    • (c) Payment information (processed by our payment providers; we do not store full card details);
    • (d) Inspection findings, including photographs, measurements, and notes.

    8.3 How we use your information. We use your information to:

    • (a) Provide the Inspection and deliver the Report;
    • (b) Issue invoices and process payments;
    • (c) Communicate about your Booking;
    • (d) Comply with our legal and regulatory obligations.

    8.4 Third parties. We share information with the following service providers, who are bound by their own privacy obligations:

    • (a) Xero (invoicing and accounting);
    • (b) Dropbox (secure file storage);
    • (c) ClickSend (SMS delivery);
    • (d) Google (calendar, email);
    • (e) Replit (website and booking infrastructure);
    • (f) Partner inspectors, where a Booking is referred under clause 7.2.

    8.5 Photographs and Reports. Photographs taken during the Inspection are retained in our records. De-identified excerpts (such as redacted report covers showing only the suburb, inspection type, and month) may appear on VG Inspect's website or marketing materials as evidence of recent work. No personally identifying information (including your name, the street address, or photographs of the Property exterior in identifiable form) will be published. If you wish to opt out of this use, please notify us in writing at adam@vginspect.com.

    8.6 Retention. We retain inspection records for seven (7) years from the date of Inspection to meet our tax, regulatory, and professional obligations. Records may be retained for longer where required by law or where reasonably necessary for VG Inspect's legitimate business interests.

    8.7 Your rights. You have the right to:

    • (a) Request access to the personal information we hold about you;
    • (b) Request correction of inaccurate or out-of-date information;
    • (c) Request deletion of your personal information (subject to our retention obligations);
    • (d) Make a complaint about our handling of your personal information.

    9. Governing Law

    9.1 These Terms are governed by the laws of the State of Queensland, Australia.

    9.2 You and VG Inspect submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from those courts.

    9.3 Your rights under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) are not affected by these Terms.

    9.4 Disputes. If a dispute arises out of or in connection with these Terms or the Inspection, the parties agree to:

    • (a) First, attempt to resolve the dispute in good faith by direct discussion, in writing where possible;
    • (b) If unresolved within twenty-one (21) days, refer the dispute to mediation through a mediator nominated by the Queensland Law Society;
    • (c) If still unresolved, refer the matter to the courts of Queensland.

    9.5 QBCC complaints. Complaints relating to the conduct of a QBCC-licensed inspector may also be referred to the Queensland Building and Construction Commission (qbcc.qld.gov.au).


    10. General

    10.1 Severability. If any provision of these Terms is held to be invalid, unenforceable, or illegal, the remaining provisions continue in full force.

    10.2 Entire agreement. These Terms, together with the Quote and Booking confirmation, constitute the entire agreement between you and VG Inspect with respect to the Inspection and supersede all prior agreements, representations, and understandings.

    10.3 Amendment. VG Inspect may amend these Terms from time to time. Amended Terms apply to Bookings made on or after the "Last updated" date shown at the top of this page. Amendments do not affect existing Bookings.

    10.4 Force majeure. Neither party is liable for failure or delay in performance caused by circumstances beyond reasonable control, including natural disaster, fire, flood, pandemic, civil disturbance, government action, or telecommunications failure.

    10.5 Assignment. You may not assign your rights under these Terms without VG Inspect's prior written consent. VG Inspect may assign its rights and obligations under these Terms in connection with a sale or restructure of the business.

    10.6 Notices. Notices to VG Inspect should be sent to adam@vginspect.com. Notices to you will be sent to the contact details supplied on your Booking.
